  1. Seller Information
    1.1. The products offered for sale on www.shop.eureka.co.it (hereafter the “Site”) are sold and invoiced by Conti Valerio S.r.l., an Italian company, headquartered in Sesto Fiorentino (FI), Via Luigi Longo no. 39/41 – 50019, REA no. FI-301141, tax code and business register number, VAT no. 03094860487 (hereinafter “Conti Valerio”).
    1.2. For any information regarding orders, shipping and, more generally, purchases, the Conti Valerio customer service can be contacted at: shop@eureka.co.it.
    1.3. These general conditions of sale (“General Conditions”) govern the sale of products by Conti Valerio via the Site to customers who qualify as consumers pursuant to Article 3 of Legislative Decree 206/2005 (Consumer Code) residing or domiciled in a Member State of the European Union, the United Kingdom or the Swiss Confederation. These conditions do not apply under any circumstances to purchases made by entities acting for professional or commercial purposes.
  2. Acceptance of the General Conditions of Sale and Conclusion of the Contract – Order cancellation
    2.1. The contract concluded between Conti Valerio and the individual who purchases on the Site, not related to their commercial, entrepreneurial, or professional activity (the “Client”), is considered concluded at the time of acceptance, even partial, of the order (“Order”) by Conti Valerio.
    2.2. In the event of non-acceptance of the order, Conti Valerio will notify the Client.
    2.3. The Client places the Order by completing the procedure required on the Site (“Order Procedure”).
    2.4. By completing the procedure, the Client declares to have read all information provided during the purchase process and to accept in full these General Conditions.
    2.5. These General Conditions may be printed or saved on a durable medium in accordance with Article 12 of Legislative Decree 70/2003 and Article 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
    2.6. The confirmed order will be archived, electronically or in paper form, by Conti Valerio and made available to the Client upon written request at 2.6.   3. 2.7 In any case, the Customer may cancel the Order within 20 minutes of completing the Order Procedure.
  4. Methods of Purchase
    3.1. Products offered for sale by Conti Valerio are exclusively those present on the Site at the time the Order Procedure is started, featuring the technical and aesthetic characteristics described in their respective information sheets.
    3.2. The images attached to the product sheet are for information purposes only and may not be perfectly representative of its characteristics; variations may occur due to the browser and screen used to view the Site and images.
    3.3. Notwithstanding the foregoing, with respect to reconditioned products (“Reconditioned Product” and collectively with the other products, “Products”), Conti Valerio provides a detailed description of any aesthetic defects and, upon specific client request, may provide photographs of the Reconditioned Products.
    3.4. The Client must provide all information required in the Order Procedure to place an Order.
    3.5. Acceptance of the Order will be confirmed by Conti Valerio by email sent to the address provided by the Client during the Order Procedure (“Order Confirmation”).
    3.6. If, after sending the Order Confirmation, one or more ordered products are unavailable, Conti Valerio will promptly inform the Client by email. In such case, the contract will be deemed not confirmed solely with respect to the unavailable products, and the Client will be reimbursed for the corresponding amount within 14 days.
  5. Prices – Delivery – Payment Methods 4.1. Prices listed on the Site are net of VAT. Products are delivered according to the Ex Works (Ex Works – Incoterms® 2020) rule; all costs related to VAT, customs duties, and import taxes are borne exclusively by the Client. 4.2. Shipping costs are borne by the Client and are always communicated to the Client in advance at the time of order confirmation. 4.3. The Product is delivered to the destination address indicated in the Order by the Client. 4.4. The Product is shipped on the working day following confirmation of the Order, according to the Italian calendar. Indicative delivery times: (i) Italy: 3 working days; (ii) continental territories of EU member states: 3 working days; (iii) rest of the world: 5–7 working days. These time frames are indicative as transport is handled by independent third party suppliers. 4.5. Accepted payment methods: 4.5.1Paypal 4.5.2Credit card 4.6. If payment is made by credit card, the transaction may be performed via the Paypal server. In no event and at no stage will Conti Valerio be able to access the Client’s credit card information, transmitted via a secure connection directly to the website of the banking institution managing the transaction. No Conti Valerio database will store this data, and in no case can Conti Valerio be held liable for any fraudulent or improper use of credit cards by third parties during payment. 4.7. Upon delivery, the Client must verify: 4.7.1the number of packages matches the transport document; 4.7.2. the packaging is intact, undamaged, not wet or otherwise altered, including closure materials. Any damage to the packaging or the Product or any discrepancy in package count or documentation must be reported immediately, indicating it on the delivery document to be handed over to the carrier.
  6. Right of Withdrawal
    5.1. Pursuant to Articles 52 et seq. of Legislative Decree 6 September 2005, no. 206 (Consumer Code), the Client qualifying as a consumer may withdraw from the purchase, without specifying any reason and without penalty, within 14 (fourteen) days of delivery.
    5.2. To exercise the right of withdrawal, the Client must notify their decision by email to shop@eureka.co.it, attaching the Withdrawal Form no. 5.2 included with these General Conditions.
    5.3. In the event of withdrawal, the Client must return the goods without undue delay and, in any case, within 14 (fourteen) days from the date the withdrawal was communicated.
    5.4. All customs and shipping costs for the return of goods are borne by the Client.
    5.5. Subject to verification of product integrity and compliance with withdrawal conditions (as outlined in the next paragraph), the refund of the price – excluding all costs borne by the Client per paragraph 4.1 above – will be made within 14 (fourteen) days of the return of the Product to Conti Valerio’s headquarters, Via Luigi Longo no. 39/41, 50019 Sesto Fiorentino (FI), using the same payment method employed by the Client. For withdrawal to be valid, Products must be unused and returned in their original packaging, accompanied by the printed withdrawal form with the relevant order number.
  7. Legal Guarantee of Conformity
    6.1. All products sold on the Site are covered by the legal guarantee of conformity, pursuant to Articles 128 et seq. of the Consumer Code.
    6.2. In case of conformity defect, the Client is entitled to restore the conformity of the goods by repair or replacement, as provided by Articles 135-bis et seq. of the Consumer Code. To expedite assistance, when the replacement of a non-compliant component (e.g., waste grain tray) can be performed without tools or technical expertise, Conti Valerio reserves the right to send the replacement part directly to the Client at Conti Valerio’s expense.
    6.3. The legal guarantee lasts two years from product delivery.
    6.4. By way of derogation, for Reconditioned Products, the parties expressly agree, per Article 133 of the Consumer Code, that the legal guarantee of conformity lasts only one (1) year from product delivery.
    6.5. To avail of the legal guarantee, the Client must send an email to shop@eureka.co.it describing the defect, attaching a video clearly showing the issue, proof of purchase (receipt), and the Warranty Assistance Form 6.5 provided with these General Conditions.
    6.6. Shipping and customs costs for returning the Product for warranty verification or repair are borne by the Client. Shipping and customs costs for redelivery of the repaired or replacement Product to the Client are borne by Conti Valerio S.r.l.
    6.7. The Legal Guarantee does not apply in the following cases:
    6.7.1. improper or negligent use of the Product; damages to the Product caused by external events (e.g. electrical surges);
    6.7.2. failure to follow the usage instructions in the Product manual;
    6.7.3. deterioration of parts subject to normal wear and tear from correct use of the Product (e.g. grinders and ACE system), as specified in the Product manual.
    6.8. If Conti Valerio accepts a warranty intervention, Products must be shipped in packaging suitable to protect them during transport. The Client is responsible for correct packaging. Conti Valerio is not liable for damages resulting from Product transport.
  8. Applicable Law and Jurisdiction
    7.2. These General Conditions are governed by Italian law.
    7.2. For any dispute regarding the application, execution, or interpretation of these General Conditions, the court of the Client consumer’s residence or domicile has jurisdiction, if located in Italy.
    7.3. Under Articles 141 et seq. of the Consumer Code, the Client qualifying as a consumer may use alternative dispute resolution (ADR) procedures, by contacting a competent body listed with the Ministry of Enterprises and Made in Italy (see https://www.mimit.gov.it/it/mercato-e-consumatori/tutela-del-consumatore/adr-conciliazione). Until discontinued, the Client may use the ODR platform provided by the European Commission at https://ec.europa.eu/consumers/odr/.

    1.1.     1.3. These general conditions (“General Condisions”) govern the offering and sale of products by Conti Valerio via the Site exclusively to entities resident in a Member State of the EU, the UK, or Switzerland who act within their entrepreneurial, commercial, artisanal, or professional activity. They do not apply to consumers as defined by Legislative Decree 206/2005.
  2. Acceptance of General Conditions and Conclusion of Contract
    2.1. The contract stipulated between Conti Valerio and the purchaser on the Site, relating to their commercial, entrepreneurial, or professional activity (the “Client”), is concluded at the time of acceptance, even partial, of the order (“Order”) by Conti Valerio.
    2.2. In case of non-acceptance, Conti Valerio will notify the Client.
    2.3. The Client completes the order procedure on the Site (“Order Procedure”).
    2.4.By completing this, the Client declares to have read all instructions provided and fully accepts these general conditions. (“General Conditions”)
  3. Methods of Purchase
    3.1. Products offered for sale are only those present on the Site at the time the Order Procedure begins, with the technical and aesthetic characteristics described in the specifications.
    3.2. Product sheet images are for informative purposes and may differ due to browser and device.
    3.3. Notwithstanding the above, for Reconditioned Products, Conti Valerio will upload photographs showing any aesthetic defects on the Site.
    3.4. The Client must provide all required information.
    3.5. Acceptance of the Order is confirmed by Conti Valerio by email (“Order Confirmation”).
    3.6. If, after sending the Order Confirmation, any ordered products are unavailable, Conti Valerio will promptly notify the Client. The contract will be consensually resolved for unavailable products and the Client will be reimbursed for those within 14 days.
  4. Prices – Delivery – Payment Methods
    4.1. Prices shown on the Site are net of VAT. Products are delivered according to the Ex Works (Ex Works, Incoterms® 2020); thus, VAT, customs duties, and import taxes are exclusively at the Client’s charge.
    4.2. Shipping costs are at the Client’s expense and are always communicated in advance at order confirmation.
    4.3. The Product is delivered to the address specified in the Order.
    The Product is shipped the next working day after order confirmation, according to the Italian calendar. Indicative delivery times: (i) Italy: 3 working days; (ii) continental territories of EU states: 3 working days; (iii) rest of the world: 5–7 working days. Delivery times are indicative as they depend on third-party shippers.
    4.4. Accepted payment methods:
    4.4.1. Paypal
    4.4.2. Credit card
    4.5. In case of payment by credit card, it can be processed via a secure server. At no time and at no stage does Conti Valerio obtain or record the Client’s credit card details, which are transmitted safely to the bank. Conti Valerio is not liable for any fraudulent use of credit cards by third parties during payment.
    4.6. Upon delivery, the Client must check:
    4.6.1. the number of packages matches the shipping document;
    4.6.2. the packaging is intact, undamaged, not wet or otherwise altered.
    Any packing or product damage or package count discrepancy must be immediately noted on the delivery document returned to the carrier.
  5. Exclusion of Right of Withdrawal
    5.1. As the Client is not a consumer, the withdrawal rules under the Consumer Code do not apply.
    5.2. Any requests for a return will be dealt with case by case at the sole discretion of Conti Valerio. In all cases, return shipping and any associated charges are borne completely by the Client, unless differently agreed in writing.
  6. Warranty for Defects and Non-Conformities – Product Returns
    6.1. Products sold are warranted for defects under Articles 1490 et seq. of the Civil Code. Warranty excludes parts subject to wear (e.g., grinders and ACE system).
    6.2. The Client shall verify the conformity and absence of defects on delivery. Any apparent defects must be reported in writing.
    6.3. By derogation, for Reconditioned Products, warranty is limited to non-apparent defects at purchase and is valid for no more than 12 months from delivery.
    6.4. The warranty may be activated by emailing shop@eureka.co.it, describing the defect, attaching a clear video, proof of purchase, and Warranty Assistance Form 6.4.
    6.5. Shipping costs for warranty products are at the Client’s charge, while return shipping (sending the repaired product to the Client) is paid by Conti Valerio.
    6.6. The Client undertakes to return warranty products in their original packaging or must ensure packaging is suitably protective.
  7. Applicable Law and Jurisdiction
    7.1. These General Terms and Conditions are governed by Italian law. The applicability of the United Nations Convention on Contracts for the International Sale of Goods and the rules of private international law and procedural law is excluded.
    7.2. For any dispute regarding interpretation, execution, or resolution, exclusive jurisdiction is held by the Court of Florence, to the exclusion of any alternative venue.
    7.3. The Parties may voluntarily use alternative dispute resolution systems under applicable law.
